Terms of Service

By creating an account or using the Euregas platform, you agree to these terms. Please read them carefully.

1. Definitions

In these Terms of Service ("Terms"), the following definitions apply:

"Platform" — The Euregas web application at euregas.eu, including all features, APIs, and services.

"User" — Any individual who creates an account on the Platform.

"Organization" — The legal entity or team that a User represents when using the Platform.

"Content" — Any data, documents, text, or files uploaded to or generated within the Platform.

"Services" — All compliance analysis, document processing, AI-powered features, and reporting capabilities provided through the Platform.

"Subscription" — The paid or free plan under which an Organization accesses the Platform.

2. Account Registration

To use the Platform, you must create an account with a valid email address and set a secure password.

Organization Admins are responsible for managing team members, permissions, and billing within their Organization.

Accuracy — You must provide accurate and current information. You are responsible for maintaining the confidentiality of your credentials.

MFA — We strongly recommend enabling multi-factor authentication (MFA). Certain features may require MFA to be enabled.

Age Requirement — You must be at least 18 years old to create an account.

One Account — Each individual should maintain only one account. Organization membership is managed through team invitations.

3. Subscription & Billing

The Platform is available under the following tiers:

Starter — Free tier with limited features and AI quota. Suitable for evaluation purposes.

Professional — Paid monthly or annual subscription with full compliance modules, increased AI quota, and priority support.

Enterprise — Custom pricing with dedicated support, custom integrations, SLA guarantees, and unlimited AI quota.

Billing — Paid subscriptions are billed in advance via Stripe. All prices are in EUR and exclude applicable VAT/taxes.

Cancellation — You may cancel your subscription at any time. Access continues until the end of the current billing period. No pro-rata refunds for partial periods.

Free Trial — If offered, trial periods convert to paid subscriptions unless cancelled before the trial ends. We will notify you before any charge.

Price Changes — We may adjust pricing with 30 days email notice. Existing subscriptions are honoured until the end of their current billing period.

4. Acceptable Use

You agree to use the Platform only for lawful compliance and regulatory purposes. You must not:

  • Use the Platform for any illegal activity or to facilitate violations of applicable law
  • Attempt to reverse engineer, decompile, or disassemble any part of the Platform
  • Use automated tools to scrape, crawl, or extract data from the Platform
  • Upload malware, viruses, or malicious content (all uploads are scanned by ClamAV)
  • Attempt to gain unauthorized access to other accounts or Platform infrastructure
  • Share your account credentials with unauthorized individuals
  • Use the Platform to store data unrelated to compliance and regulatory purposes
  • Circumvent usage limits, AI quotas, or access controls

We reserve the right to suspend or terminate accounts that violate these terms.

5. Intellectual Property

Platform IP — The Euregas platform, including its source code, design, algorithms, documentation, and branding, is owned by Euregas and protected by intellectual property laws. Your subscription grants a limited, non-exclusive, non-transferable license to use the Platform.

Your Content — You retain full ownership of all Content you upload to or create within the Platform. We do not claim any intellectual property rights over your Content.

AI-Generated Outputs — Compliance analyses, risk assessments, and other outputs generated by AI features belong to your Organization. You are responsible for reviewing and validating these outputs before acting on them.

Feedback — If you provide feedback or suggestions about the Platform, we may use them to improve our services without obligation to you.

6. Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, process, and protect your data.

Data Controller/Processor — For personal data you upload to the Platform (e.g., employee records in DPIAs, incident reports with personal data), your Organization is the data controller and Euregas acts as data processor.

Data Processing Agreement — A DPA is available on request for Organizations that require one under GDPR Art. 28. Contact legal@euregas.eu.

Data Export — You can export your data at any time in JSON or CSV format through the Platform's export features.

Data Location — All data is stored and processed within the EU (Germany). See our Privacy Policy for details.

7. AI Services Disclaimer

The Platform includes AI-powered features for compliance analysis, document review, risk assessment, and regulatory guidance. These features are subject to the following:

Not Legal Advice — AI-generated outputs are informational tools to assist your compliance efforts. They do not constitute legal advice. You should consult qualified legal professionals for legal decisions.

No Guarantee of Compliance — While we strive for accuracy, AI outputs may contain errors or omissions. Euregas does not guarantee that using the Platform will make your Organization compliant with any regulation.

PII Scrubbing — All documents are processed through PII scrubbing (Microsoft Presidio) before AI analysis. However, you should avoid uploading highly sensitive data unnecessarily.

AI Quota — AI features are subject to usage quotas based on your subscription tier. Quota resets monthly.

Continuous Improvement — AI capabilities evolve over time. We may update AI models and features to improve accuracy and coverage.

8. Availability & Support

Uptime — We aim for high availability but do not guarantee uninterrupted service for Starter and Professional tiers. Enterprise customers receive SLA guarantees as specified in their agreement.

Maintenance — We perform planned maintenance during low-traffic hours (typically weekends, CET night time). We will notify you of extended maintenance windows via email.

Support — Support is provided via email (support@euregas.eu). Response times depend on subscription tier:

Backups — We maintain automated daily backups. In case of data loss due to our error, we will restore from the most recent backup.

9. Limitation of Liability

The Platform is a compliance tool, not legal counsel. Regulatory compliance ultimately depends on your Organization's actions, processes, and legal interpretation.

Liability Cap — To the maximum extent permitted by law, Euregas's total liability for any claims arising from your use of the Platform is limited to the amount you paid us in the 12 months preceding the claim.

Exclusions — Euregas is not liable for: • Indirect, incidental, consequential, or punitive damages • Loss of profits, data, or business opportunities arising from use of the Platform • Regulatory fines or penalties imposed on your Organization • Actions taken or not taken based on AI-generated outputs • Service interruptions caused by third parties, force majeure, or your own systems

Indemnification — You agree to indemnify Euregas against claims arising from your misuse of the Platform or violation of these Terms.

Nothing in these Terms limits liability for fraud, gross negligence, or death/personal injury caused by our negligence.

10. Termination

By You — You may terminate your account at any time by cancelling your subscription and requesting account deletion through the Platform settings or by emailing legal@euregas.eu.

By Us — We may suspend or terminate your account: • Immediately, for material breach of these Terms (including acceptable use violations) • With 30 days notice, for any other reason

Effect of Termination — Upon termination: • Your access to the Platform ceases at the end of the current billing period (or immediately for breach) • You have 30 days to export your data • After 30 days, all your Content and personal data is permanently deleted (subject to legal retention requirements) • Encrypted backups are purged within 90 days

Survival — Sections 5 (IP), 9 (Liability), 11 (Governing Law), and this survival clause continue after termination.

11. Governing Law & Disputes

These Terms are governed by the laws of Finland, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved by the Helsinki District Court (Helsingin käräjäoikeus) as the court of first instance.

For EU consumers: Nothing in these Terms affects your statutory rights under mandatory consumer protection laws of your country of residence.

12. Changes to These Terms

We may update these Terms to reflect changes in our services or applicable law.

For material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

If you do not agree with the changes, you may terminate your account before the effective date.

The "Effective date" at the top of this page indicates the date of the most recent revision.
